1. Seller

2. Purpose
Abracarda sells two distinct things, governed by different rules:
- a physical medium — NFC card, sticker or plaque, personalised with the customer's name and delivered encoded. One-off purchase.
- a subscription to the service — the public page, its editor, the statistics and the modules. Billed monthly or yearly.
The medium works for as long as the subscription is active: it holds no data, it points to a page hosted by us. That is what allows the content to change without reprinting the card, and it is also why the two are linked.
3. Prices
Prices shown on the site are in euros. TVA non applicable, article 293 B du CGI.
Prices for media are indicative and vary with quantity and printing; the firm price is the one in the accepted quote. Subscription prices are those displayed at the time of signing up.
A price change never applies to a period already paid for. It is announced at least thirty days before the renewal date, and the customer may cancel before then.
4. Ordering and payment
Media are ordered by WhatsApp or by email, and the order is firm only once the quote is accepted and payment made.
The subscription is taken out online. Payments are processed by Stripe Payments Europe; we neither see nor keep any card number.
5. Delivery
Media are shipped to the address given by the customer. The indicative lead time is seven working days after the artwork is approved, and runs from that approval — not from the order.
On receipt, check that the card does open the expected page. Any medium found faulty on delivery is replaced free of charge.
6. Right of withdrawal
A consumer customer has fourteen days to withdraw, from receipt of the medium or from signing up to the subscription.
Important exception: media are personalised with the customer's name. Under article L221-28 3° of the French Consumer Code, goods made to the consumer's specifications carry no right of withdrawal once manufacture has begun. A medium not yet personalised can still be returned.
The subscription, for its part, can be withdrawn from in all cases during those fourteen days and is refunded in full.
An order placed for the purposes of a business activity does not, in principle, carry a right of withdrawal.
7. Term, cancellation and end of subscription
The subscription has no minimum term. It renews automatically at each due date and can be cancelled at any time from the customer dashboard.
Cancellation takes effect at the end of the period already paid for: the service remains accessible until then, and no pro rata amount is refunded.
After that date, the public page is taken offline. The physical medium remains the customer's property but no longer displays anything useful. Account data is kept for three months, which allows the subscription to be resumed without re-entering everything; beyond that, it is deleted.
If a payment fails, the service is suspended after a reminder. It is restored as soon as the situation is regularised.
8. Customer obligations
The customer is solely responsible for the content they publish on their page. They warrant that they hold the rights to the text, images and logos placed there.
We may disable without notice any page that is manifestly unlawful, misleading, or that impersonates a third party.
By default, whatever the rating, the reviews module offers both leaving a public review and sending a private message. Filtered mode, which directs only satisfied customers to Google, breaches Google Business rules: a customer who enables it bears the consequences alone, including the possible removal of their listing.
9. Availability
We use reasonable means to keep the service accessible, with no contractual availability guarantee. Maintenance interruptions are announced where they are foreseeable.
10. Personal data
Data processing is described in the privacy policy.
11. Disputes and mediation
In the event of disagreement, write to us first: most situations are settled that way.
Failing agreement, a consumer customer may use a consumer mediator free of charge, or the European online dispute resolution platform — ec.europa.eu/consumers/odr.
This contract is governed by French law.
